Whilst reasonable efforts have been made to ensure the accuracy of the Material published on this website, WebPlatform4Dialogue makes no warranties or representations as to its accuracy, completeness, reliability, suitability, currency or comprehensiveness and assumes no liability or responsibility for any error or omission and/or for any loss, damage, liability or expense arising in connection with or attributable to any action or decision taken as a result of using or relying on the Material of this website.
WebPlatform4Dialogue moderator only has the right to publish, distribute and promote in various social and collaborating network platforms. This sharing is limited to the created hyperlink (Public) of the video/ content hosted by WebPlatform4Doalogue moderator in their hosting page. Both parties should distribute with ‘No Harm’ process. The content/video hosting might change based on the performance of availability of website. Author will be duly notified in that case.
In any case, the digital content cannot be distributed in physical form (Pen drive, CV, Memory card etc.) without consent of WebPlatform4Dialogue moderator. This also includes of hosting of these videos in any kind of cloud storage (Drop box, Google drive etc.) and video hosting websites ( YouTube, Vimeo etc.).
Intellectual Property
The Material contained in this website, including without limitation text, software, scripts, graphics, photos, sounds, music, videos, material, interactive features, and files is owned or licensed by WebPlatform4Dialogue and subject to copyright and other intellectual property rights under law. Unauthorized reproduction, copying, including any alteration, translation or disassembly work, distribution, transmissions, broadcasting, sale, licensing or any other form of exploiting is not permitted unless prior written consent has been granted from WebPlatform4Dialogue. Users will be held responsible to WebPlatform4Dialogue for damages in case of non-observance of this clause.
Provided these Terms and Conditions are fully respected, a User who maintains a website can include hyperlinks to WebPlatform4Dialogue’s website or to any of its pages on that site, without having to ask permission. However, this does not include permission to use WebPlatform4Dialogue’s logo or its intellectual property without its prior written authorization. A link to WebPlatform4Dialogue’s website may not be used for the promotion of an organization, company or individual or of any commercial products or services.
This site may contain advice, opinions and statements of various information providers. WebPlatform4Dialogue does not represent or endorse the accuracy or reliability of any advice, opinion, statement or other information provided by any third party. iv. The User may not copy, republish, lend, post on servers, transmit or redistribute to any mailing lists this information for commercial purposes or for compensation of any kind. Commercial purpose means work generated for, or resulting in the receipt of income, pro bono or research work done with the hope of earning money in the future as a result of the work, and work which will be later used for commercial projects even if not so used now.
The User agrees to indemnify fully and to hold WebPlatform4Dialogue indemnified from and against any claim brought by a third party resulting from the use of the website and in respect of the losses, costs, actions, claims, expenses or liabilities whatsoever suffered or incurred directly by WEBPLATFORM4DIALOGUE in consequence of the breach or non-observance by the User of these Terms and Conditions.
If this Site contains bulletin boards, chat rooms, access to mailing lists or other message or communication facilities (hereinafter collectively “Forums”), the User agrees to use the Forums only to send and receive messages and materials that are proper and related to the particular Forum. By way of example and not as a limitation, the User agrees that when using a Forum, he or she shall not do any of the following:
(a) Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others;
(b) Publish, post, distribute or disseminate any defamatory, infringing, obscene, indecent or unlawful Material or information or any other content that advocates unsafe or illegal activities (e.g. drug abuse, bomb making) or features graphic or gratuitous violence;
(c) express any view that could be considered hate speech (speech which attacks or demeans a group based on race or ethnic origin, religion, disability, gender, age, veteran status, and sexual orientation/gender identity);
(d) Upload or attach files that contain software or other Material protected by intellectual property laws (or by rights of privacy and publicity) unless the User owns or controls the rights thereto or has received all consents therefor as may be required by law;
(e) Upload or attach files that contain viruses, corrupted files or any other similar software or programs that may damage the operation of another’s computer;
(f) Delete any author attributions, legal notices or proprietary designations or labels in any file that is uploaded;
(g) Falsify the origin or source of software or other Material contained in a file that is uploaded;
(h) Advertise or offer to sell any goods or services, or conduct or forward surveys, contests or chain letters, or download any file posted by another User of a Forum that the User knows, or reasonably should know, cannot be legally distributed in such manner.
The User acknowledges that all Forums and discussion groups are public and not private communications. Further, the User acknowledges that chats, postings, conferences, e-mails and other communications by other Users are not endorsed by WebPlatform4Dialogue, and that such communications shall not be considered to have been reviewed, screened or approved by WebPlatform4Dialogue. WebPlatform4Dialogue reserves the right to remove, for any reason and without notice, any content of the Forums received from Users, including, without limitation, e-mail and bulletin board postings.
General
WebPlatform4Dialogue reserves the right to change and amend these Terms and Conditions from time to time without notice, and the User hereby agrees that the new Terms and Conditions shall take precedence over the previous terms. WebPlatform4Dialogue shall have no obligation to take the needs of any User into consideration in connection therewith.
WebPlatform4Dialogue reserves the right to deny in its sole discretion any User access to this Site or any portion thereof without notice.
No waiver by WebPlatform4Dialogue of any provision of these Terms and Conditions shall be binding except as set forth in writing and signed by its duly authorized representative.
